I. Statutory mechanism to extend a TIF requires legislation adopted by
General Assembly and approved by the Governor.
II. For extension approval by legislation it will need support by
public schools impacted.
III. City will request the extension.
a. This allows for the school to
negotiate financial reimbursement for their consent of extension.
b. If the school has not received money in the past, allowing for
various reimbursement possibilities.
c. If been “made whole” in the past, allows for additional revenue,
such as interest on late state aid reimbursement or impact fees.
IV. School have actual power at this stage.
a. If residential TIF need to look at
financial impact fees.
b. Need to understand impact of TIF and be able to explain your need.
V. Intergovernmental Agreement
a. Have a written agreement with the
city representing the school's conditions for extension.
b. Letters of support to area legislation needed. At least one
legislator will need to carry the legislation after city and school
have agreement.
VI. Downside of Extension
a. False indication to legislators and
public of TIF support.
b. May encourage additional TIFs.
c. TIF expansion hurts the General School Revenue Funds impacting all
schools in the state.
d. State aid reimbursement is two (2) years later than local tax
extension.
